EU Parliament votes for postponement
The new EU regulation on rules for organic foods should have come into force at the turn of the year. Due to the emergence of the corona pandemic with all its consequences, many resources were tied up elsewhere, so that it soon seemed foreseeable that the time frame set for the elaboration would be short.
After the EU Commission submitted the application for postponement at the beginning of September, the EU Parliament has now also given the green light for a postponement by one year and the start on January 1, 2022.
Now the member states have to formally approve the postponement with a Council of Ministers resolution. This could be done at the next Agriculture Council. This would leave more time to prepare the subordinate legal acts for Regulation (EU) 2018/848.
Until the new legislation comes into force, the existing regulation according to Regulation (EC) No. 834/2007 and its implementing regulations (EC) No. 889/2008 and (EC) No. 1235/2008 will continue to apply.

EU- Parlament stimmt für Startverschiebung
Eigentlich sollte zum Jahreswechsel das neue EU-Bio-Recht in Kraft treten. Durch das Aufkommen der Corona-Pandemie mit all seinen Konsequenzen wurden viele Ressourcen anderweitig gebunden, so dass bald absehbar schien, dass der angesetzte Zeitrahmen für die Ausarbeitung knapp werden würde.
Nachdem die EU-Kommission Anfang September den Antrag zur Verschiebung eingereicht hatte, gab nun auch das EU-Parlament grünes Licht für eine Verschiebung um ein Jahr und den Start zum 1. Januar 2022.
Nun müssen noch die Mitgliedsstaaten mit einem Ministerratsbeschluss der Verschiebung formell zustimmen. Dies könnte bereits beim nächsten EU-Agrarministerrat erfolgen. Damit bliebe mehr Zeit, um die nachgeordneten Rechtsakte für die Verordnung (EU) 2018/848 auszuarbeiten.
Bis zum Inkrafttreten des neuen Bio-Rechts gilt weiterhin das bestehende Öko-Recht gemäß Verordnung (EG) Nr. 834/2007 und ihren Durchführungsverordnungen (EG) Nr. 889/2008 und (EG) Nr. 1235/2008.
